Persecution

In order to be granted asylum, an individual must prove to USCIS or to an immigration judge that he or she has a "well-founded" or "reasonable" fear of harm if returned to the native country. The individual must show either past harm or fear of future harm as well as some evidence as to the motivation of the persecutor. Additionally, the applicant must show that there is evidence that this fear of harm is based on one of five grounds-race, religion, nationality, political opinion, or membership in a particular social group.
It is not enough for an asylum applicant to show that general country conditions-such as crime, poor economy, etc.-are bad, or even terrible. For a successful asylum application, the applicant must show that he or she suffered past persecution or fears future persecution because of one of the five protected grounds mentioned above.
For those who are ultimately successful in gaining asylum, their spouse or children may also be granted asylum regardless of whether they entered the U.S. with the individual or want to follow to join him or her here. After one year of holding asylum status, one may apply for legal permanent resident status.
